1. Overview and operator
These Terms and Conditions of Sale (the Terms) govern purchases made through the Jacqueline van Hoef online store at www.jacquelinevanhoef.co.uk. Jacqueline van Hoef is the customer-facing name of this online store, which is legally operated by Vouge Verde Mösch. Vouge Verde Mösch is a Swiss sole proprietorship owned by Flynn Miró Mösch, with its registered address at Bahnhofstrasse 12, 2502 Biel/Bienne, Switzerland, and company identification number CHE-418.910.820 (Vouge Verde, we, us or our).
By submitting an order, you confirm that you have had the opportunity to read and accept the Terms in force at that time. These Terms do not exclude or restrict rights that cannot lawfully be excluded or restricted.
2. Eligibility and permitted use
You must have the legal capacity required to enter into the purchase agreement. If you place an order for or on behalf of a minor or another person, you confirm that you are authorised to do so.
You may not use the online store, its content or our products for an unlawful or unauthorised purpose, or in a way that infringes applicable law or the rights of another person.
3. Products and product information
We aim to describe products accurately, including their principal characteristics, materials, sizing, fit, care information, prices, availability and delivery information. Please review the product description and size information before ordering. Measurements are approximate and fit can vary by style and construction.
Images are illustrative. Colours and appearance may vary because of screen settings, lighting, photography or minor production variations that do not materially affect the product. Availability, prices and promotions may change before an order is submitted.
If a material error affects an order, we may contact you to request confirmation based on the corrected information or cancel the affected item. Any amount already paid for a cancelled item will be refunded using the original payment method where reasonably possible.
4. Prices and payment
Prices are shown in the currency displayed at checkout. The price shown when the order is submitted applies to that order, subject to the correction of obvious errors. All applicable taxes, import VAT, customs duties and mandatory import-clearance charges are included in the price or checkout total. Delivery costs, if any, are shown before the order is submitted. Customers are not required to pay additional taxes, customs duties or mandatory carrier-clearance charges on delivery.
Payment must be made using a method offered at checkout. We may decline, hold or cancel an order if payment cannot be authorised or verified, if fraud or misuse is reasonably suspected, or if the order information is materially incomplete or incorrect.
5. Ordering and formation of the contract
The ordering process allows you to select products, review your basket, enter billing and delivery details, choose available delivery and payment options, review and correct input errors, and submit the order using a clearly labelled button indicating an obligation to pay.
Product displays are invitations to place an order. By submitting an order, you make a binding offer to purchase the selected products. We will send an electronic acknowledgement without undue delay. Unless that message expressly states otherwise, it only confirms receipt and is not acceptance of the order.
The purchase contract is formed when we expressly accept the order or dispatch the products, whichever occurs first. We may refuse or limit an order for legitimate reasons, including unavailability, a pricing or description error, payment concerns, suspected fraud, legal restrictions or an unavailable delivery destination. If we do so after receiving payment, we will refund the affected amount.
6. Shipping and delivery
Available delivery destinations, dispatch and handling information, delivery options, charges and any free-shipping thresholds are stated in the Shipping Policy or at checkout. Unless a product page or the Shipping Policy states otherwise, orders are dispatched directly by our fulfilment and sourcing partners in China. The carrier and dispatch location may vary.
Delivery times are estimates unless expressly agreed as binding. They may be affected by carrier operations, customs clearance, weather, public holidays, local delivery conditions and other circumstances outside our reasonable control. We will inform you of a material delay when reasonably possible.
For UK consumer orders, we will deliver without undue delay and no later than 30 days after the contract is formed unless a different period has been expressly agreed.
You must provide complete and accurate delivery and contact details. If a parcel is returned or delivery fails because the information supplied was incorrect or incomplete, we may charge reasonable additional delivery costs where permitted by law and after informing you.
Risk of loss or damage passes to a consumer when the products are delivered to the consumer or a person designated by the consumer, subject to any mandatory rule that provides greater protection.
7. Returns, cancellations and refunds
Returns, exchanges and cancellation rights are governed by the Return & Refund Policy made available through the online store. UK consumers generally have 14 days after delivery to notify us that they wish to cancel an eligible distance-sale order and a further 14 days after giving notice to send the goods back. Any voluntary return right for orders outside the UK is limited to the conditions stated in that policy unless mandatory law provides more favourable rights.
If mandatory law applicable to a customer grants a cancellation, return or refund right, that right remains unaffected. Lawful restrictions may apply to personalised or made-to-order items and to sealed goods that are unsuitable for return for health or hygiene reasons after the seal has been broken; any applicable restriction will be stated in the Return & Refund Policy or before purchase.
Nothing in this section affects rights relating to products that are defective, damaged, incorrectly supplied or not as described.
8. Defects and warranty
Please check products promptly after delivery and contact us within a reasonable time if an item is damaged, defective, incorrectly supplied or missing. A delay in notifying us does not remove rights that cannot lawfully be waived.
Mandatory statutory warranty and conformity rights apply. Depending on the circumstances and applicable law, the appropriate remedy may include repair, replacement, a price reduction, cancellation of the affected purchase or a refund. Any separate commercial guarantee will apply in addition to, and not instead of, mandatory rights unless the law permits otherwise.
9. International orders, customs and duties
All applicable taxes, import VAT, customs duties and mandatory import-clearance or carrier charges are included in the price or checkout total. We arrange delivery on a duties-and-taxes-paid basis or use an equivalent arrangement so that customers are not required to pay additional import charges on delivery. If a carrier requests such a payment, contact us before paying so that we can resolve it.
We do not alter commercial invoices to describe purchases as gifts or to state a value lower than the actual transaction value. Customs processing can delay delivery. Mandatory consumer rights in a country to which we direct sales remain unaffected.
10. Billing, delivery and account information
You agree to provide current, complete and accurate purchase, billing, delivery and account information. You are responsible for keeping those details up to date so that we can process the order and contact you when necessary. You must keep account credentials confidential and notify us promptly if you suspect unauthorised access.
11. Third-party services and links
The online store may use third-party services for hosting, payments, analytics, fulfilment or delivery, and may link to third-party websites. Separate third-party terms may apply. We are not responsible for third-party content or availability, but this does not affect liability that we have under mandatory law for service providers used to perform our obligations.
12. Personal information
Our collection and use of personal information are governed by the Privacy Policy available through the online store. That policy should be read together with these Terms.
13. Customer content and feedback
If you submit a review, comment, image, suggestion or other content, you confirm that you have the right to share it and that it is lawful, accurate to the best of your knowledge, and does not infringe another person's rights. You grant us a non-exclusive right to display and use submitted content for operating and improving the online store, subject to applicable data protection and consumer law. We may remove content that is unlawful, misleading, abusive or unrelated to the relevant product or service.
14. Intellectual property
The online store and its original content, branding, text, graphics and other materials are owned by or licensed to Vouge Verde and are protected by applicable intellectual property laws. You may use them only for personal, non-commercial shopping purposes unless we give prior written permission.
15. Prohibited uses
You must not use the online store or its content to:
- break applicable law, encourage unlawful activity or infringe intellectual property, privacy or other rights;
- transmit malware, harmful code, spam or deceptive communications;
- collect or process personal data without a lawful basis or appropriate permission;
- circumvent security controls, interfere with the store's operation, or attempt unauthorised access; or
- misrepresent your identity, payment authority, delivery information or intended use of the service.
16. Website availability and disclaimers
We take reasonable steps to keep the online store accurate, secure and available. We do not promise uninterrupted or error-free access and may suspend access for maintenance, security, legal or operational reasons. Product-specific warranties and mandatory statutory protections are not affected by this section.
17. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct or gross negligence, death or personal injury where applicable, mandatory product liability, or mandatory consumer rights.
To the fullest extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed, or for loss caused solely by an event outside our reasonable control. If you are a consumer, this limitation does not exclude direct loss caused by our breach of contract or failure to exercise legally required care.
18. Events outside reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control, provided that we take reasonable steps to reduce its effects and resume performance. If such an event materially prevents performance, either party may exercise any cancellation right available under applicable law, and we will refund prepaid amounts for products not supplied.
19. Suspension and termination
We may suspend or terminate access to an account or the online store if you materially breach these Terms, misuse the service or create a security or legal risk. This does not affect rights and obligations arising from an order already accepted, unless cancellation is permitted by these Terms or applicable law.
20. Severability and no waiver
If a provision is held to be unlawful, invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A delay or failure to enforce a right is not a waiver of that right.
21. Entire agreement
These Terms, together with the product information, order confirmation, Privacy Policy, Shipping Policy and Return & Refund Policy applicable to the order, form the agreement between you and Vouge Verde for purchases through the online store. In the event of a conflict, mandatory law prevails, followed by any individually agreed term and then these Terms.
22. Governing law and jurisdiction
For a consumer who lives in the United Kingdom, these Terms and the purchase contract are governed by the law of the part of the United Kingdom in which that consumer lives, and the consumer may bring proceedings in the courts available there. For customers outside the United Kingdom, Swiss law applies, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods, to the extent that this choice is legally permitted.
Every consumer retains the protection of mandatory law and any mandatory place of jurisdiction available in the consumer's country or place of residence. For disputes that do not involve a consumer, the courts at Biel/Bienne, Switzerland, have exclusive jurisdiction where legally permitted.
23. Changes to these Terms
We may update these Terms by publishing a revised version through the online store. The version made available and accepted when an order is submitted applies to that order. Changes do not retrospectively alter an existing purchase contract unless required by law or agreed with the customer.
